TERMS OF USE

1. OBJECT

The general terms and conditions of sale presented here govern the contractual relationship between Maxime Guengant and any customer using the online store for photographic prints accessible at www.maximeguengant.com. They are applicable to all purchases made on the www.maximeguengant.com website.

2. NATURE OF PRODUCTS SOLD

The products sold on the www.maximeguengant.com website are photographic prints. The photographs of the products appearing on the product sheets are intended to be as faithful as possible to the original colors. The color may therefore vary from one screen to another. Product photos are therefore not contractually binding.

 

3. ORDERING

The user may place an order on the www.maximeguengant.com website without having to create an account.

Validation of an order implies full acceptance of the General Terms and Conditions of Sale.

The following payment methods are available via the site: Credit Card, Apple Pay, PayPal, Stripe.

The buyer is invited to check the personal details (e-mail and postal address) he/she provides, as they are used to process the order and send the print. Any error due to an incorrect address will result in new shipping costs being charged to the buyer.

The prices quoted for each print depend on the size and finish required, and do not include postage. These will be calculated when the order is finalized.

An invoice will be issued by Maxime Guengant and sent to the e-mail address given at the time of ordering if the customer so wishes.

4. DELIVERY TIME

The prints ordered are not in stock. The quantity available indicated on the product page corresponds to the number of prints still available in the series.

The order therefore involves sending the file to the printer, then checking the print by Maxime Guengant, who must sign and number it. After this, the parcel is picked up by a delivery service. A period of 10 to 12 days is therefore indicated between the placing of the order and receipt of the prints.

A tracking number will be e-mailed to the purchaser as soon as the order has been dispatched.

As the delivery time depends on the carrier, any delay cannot be the subject of a claim or complaint, and no compensation can be requested from Maxime Guengant.

If, for exceptional reasons, the order processing time should be longer, the buyer will be informed by e-mail.

5. RECEIPT OF PARCEL

To guarantee optimum quality, prints are wrapped in tissue paper to prevent scratching. The prints are then placed either flat in a reinforced box, or in a cardboard tube (depending on the size and quantity of prints).

If your package is damaged on delivery (folded box, crushed tube), you must refuse it so that it can be returned to me.

Fine ART prints must be handled with care, and particular attention must be paid when unpacking the parcel. Any negligence resulting in damage to the print will be the sole responsibility of the customer. To ensure that you retain all the qualities of the print, we strongly recommend that you handle it with cotton gloves to avoid damaging the surface or leaving fingerprints.

 

6. RETRACTION PERIOD

In accordance with article L121-21 of the French Consumer Code, the Purchaser has 14 days from receipt of the order to return, at his or her own expense, the print(s) in their original packaging, together with the invoice and certificate(s) of authenticity. Refunds will be made within 20 working days of receipt of the prints in their original condition.

As the prints are intended specifically for one buyer and are printed to order, the right of withdrawal does not apply. The buyer may contact Maxime Guengant to find an arrangement if necessary.

 

7. INTELLECTUAL PROPERTY RIGHTS

Numbered and signed prints sold on the www.maximeguengant.com website are protected by the French Intellectual Property Code.

The Buyer is informed that, by virtue of article L111-3 of the French Intellectual Property Code, the acquisition of a print does not confer any intellectual property rights on the work. Any reproduction or distribution is forbidden without the prior agreement of the Author. Any use that does not comply with legal provisions constitutes counterfeiting and will be liable to prosecution under articles L122-4 and L335-2 of the French Intellectual Property Code.

8. APPLICABLE LAW AND JURISDICTION

These general terms and conditions of sale and the contractual relationship between the Buyer and the Author are governed by French law.

In the event of a dispute, and in accordance with the provisions of the French Consumer Code, the Buyer has the right to call upon a mediation service.

In accordance with article L 152-2 of the French Consumer Code, in order for a dispute to be examined by an external body, the buyer must be able to justify that he/she has previously tried to resolve his/her dispute directly with Maxime Guengant. This dispute may be brought to the attention of Maxime Guengant by e-mail or post.
